Terms of Service — Apex Aerials
Last updated: 18th of July 2026 These Terms of Service ("Terms") govern the use of drone photography and videography services provided by Apex Aerials ("we", "us", "our"), based in Woodchurch, Ashford, Kent. By booking a shoot with us, you ("the client") agree to these Terms.
1. Services
We provide aerial photography and videography services, offered as Standard, Premium, and Platinum packages, as described on our website or in your quote. Exact deliverables are confirmed at the time of booking.
2. Booking & Payment
A booking is confirmed once a deposit has been paid. The remaining balance is due within 2 days of the client confirming they're happy with the delivered footage. Payments are processed securely via Stripe. Deposits are non-refundable except where we are unable to complete the shoot due to circumstances within our control (see Section 6).
3. Complimentary/Portfolio Shoots
From time to time, we offer complimentary shoots to local businesses in exchange for usage rights (e.g. social media, portfolio use). These shoots are not covered by payment-related terms in this document but remain subject to the licensing terms in Section 4 and the usage rights agreed at the time.
4. Ownership & Licensing
Apex Aerials retains full copyright and ownership of all photographs and video footage captured during a shoot. Clients are granted a license to use the delivered footage for the purposes agreed at booking (e.g. marketing, personal use, website). Any use beyond what was agreed — including resale, sublicensing, or use by third parties — requires our prior written consent. We reserve the right to use footage from paid shoots in our own portfolio and marketing materials, unless otherwise agreed in writing with the client.
5. Delivery
Watermarked previews and final footage are delivered via our secure platform, Fast.io. Final footage is typically delivered within 4–7 days of the shoot. Delays due to weather rescheduling or technical issues will be communicated promptly.
6. Weather, Safety & Rescheduling
All flights are conducted in accordance with UK Civil Aviation Authority (CAA) regulations. We reserve the right to postpone or cancel a shoot due to unsafe weather conditions, airspace restrictions, or other safety concerns. If we cancel due to the above, we will offer a reschedule at no extra cost. No refund is due in this case, as the booking remains valid for the rescheduled date.
7. Client Responsibilities
The client agrees to: Provide accurate site information and safe access for the shoot Obtain any necessary permissions from landowners or relevant authorities for the shoot location, unless otherwise agreed Ensure the site is reasonably clear of hazards that could obstruct safe drone operation
8. Insurance & Liability
Apex Aerials holds £1,000,000 public liability insurance. Our liability is limited to the value of the services booked. We are not liable for indirect or consequential losses. We are not liable for delays or non-performance caused by circumstances outside our reasonable control (see Section 9).
9. Force Majeure
We are not responsible for failure to perform our obligations due to events beyond our reasonable control, including but not limited to severe weather, airspace restrictions, equipment failure, or regulatory changes.
10. Changes to These Terms
We may update these Terms from time to time. The "last updated" date at the top will reflect the most recent changes. Continued use of our services after changes constitutes acceptance of the updated Terms.
